EU-Datenschutz: USA lenken ein

Die sieben Regeln für US-Firmen im Umgang mit dem neuen
EU-weiten Datenschutzgesetz sind eingestandenermassen
nur ein Anfang, aber sie deuten draufhin, dass die US-
Administration von ihrem Beharren auf der totalen
Selbstkontrolle durch die Industrie abgehen will. "Das letzte

November 10, 1998 The Clinton administration has released a
proposed voluntary approach for U.S. companies to meet the
requirements of European privacy laws.

The lack of comprehensive privacy laws in the United States
has raised the specter of a major trade dispute with the
European Union over Europe's privacy directive, which took
effect last month.

In the U.S. proposal, the administration would consider
companies that abide by seven privacy principles to be
meeting the European requirements.

A Commerce Department official said the seven principles
reflect the administration's previous discussions with U.S.
companies, but had not been approved by European officials.
''We're really in the infancy stage,'' the official said.

Under the EU directive, European companies may be
prohibited from exchanging data with companies in other
countries that do not provide adequate protection of data
privacy.

Under the administration's proposal, consumers must be told
what information a company collects and how it is used. The
consumer should be allowed to prevent data from being
collected or distributed and would have an opportunity to
correct inaccurate information.

U.S. privacy advocate Marc Rotenberg said the public
release of the seven principles might be an indication that the
administration is ready to move away from the voluntary,
industry-led approach.

After failing to persuade the Europeans to accept voluntary
standards, "they painted themselves into a corner and they're
trying to create space to look at other options,'' he added.

Commerce Secretary William Daley said in a speech at the
conference that negotiations over the privacy directive could
be completed by the end of the year. "The last thing we need
is disruption of electronic commerce across the Atlantic,''
Daley said.
